Ce contrat couvre les cons\u00e9quences p\u00e9cuniaires de la responsabilit\u00e9 l\u00e9gale de l\u2019employeur en cas d\u2019accidents du travail pouvant atteindre ses pr\u00e9pos\u00e9s au cours de leur activit\u00e9 professionnelle y compris les risques du trajet. Dans ce cas, le souscripteur s&rsquo;engage \u00e0 fournir \u00e0 la compagnie d\u2019assurances une copie certifi\u00e9e conforme de l\u2019envoi relatif \u00e0 la d\u00e9claration du personnel et des salaires, conform\u00e9ment \u00e0 la l\u00e9gislation relative au r\u00e9gime de s\u00e9curit\u00e9 sociale. Ensuite, l\u2019employeur proc\u00e8de, dans un d\u00e9lai de 48 heures, \u00e0 une d\u00e9claration aupr\u00e8s des autorit\u00e9s locales, municipales ou, \u00e0 d\u00e9faut, aupr\u00e8s de la gendarmerie ou du chef du poste de police dont rel\u00e8ve le lieu de l\u2019accident. Puis, l\u2019employeur fournit les certificats (de constatation, de prolongation et de gu\u00e9rison) aux autorit\u00e9s locales. Ces derni\u00e8res sont tenues, en vertu des dispositions du dahir datant de 1963, de transmettre la d\u00e9claration de l\u2019AT ainsi que les certificats au tribunal comp\u00e9tent dans un d\u00e9lai de 15 jours. Quant \u00e0 l\u2019autorit\u00e9 locale, elle a l\u2019obligation d\u2019informer l\u2019inspecteur du travail.&nbsp;<\/li>\n<li style=\"box-sizing: inherit; margin-bottom: 8px; padding-left: 8px; border-color: rgba(0, 0, 0, 0.9); border-style: none; border-image: none 100% \/ 1 \/ 0 stretch; background-image: none; background-position: 0% 0%; background-size: auto; background-repeat: repeat; background-attachment: scroll; background-origin: padding-box; background-clip: border-box;\">Proc\u00e9dure judiciaire&nbsp;: D\u00e8s r\u00e9ception du dossier, le tribunal proc\u00e8de \u00e0 l\u2019ouverture d\u2019une enqu\u00eate sur les conditions de survenance de l\u2019accident. Cette enqu\u00eate int\u00e8gre \u00e9galement la v\u00e9rification et le contr\u00f4le de certaines informations propres \u00e0 l\u2019employ\u00e9 et \u00e0 l\u2019employeur (r\u00e9mun\u00e9ration, situation financi\u00e8re de l\u2019entreprise..). De plus, le tribunal engage une proc\u00e9dure de conciliation judiciaire qui vise \u00e0 faire une proposition d\u2019offre d\u2019indemnisation \u00e0 la victime. En cas d\u2019accord, le traitement et la liquidation de l\u2019indemnisation sont enclench\u00e9s. Elle est payable aux \u00e9poques et lieux de paies usit\u00e9s par l&#8217;employeur et sans distinction entre jours ouvrables et jours de repos hebdomadaires. Le calcul de l&rsquo;indemnit\u00e9 est \u00e9gal aux deux tiers de la r\u00e9mun\u00e9ration quotidienne \u00e0 compter du premier jour suivant l&rsquo;accident ou la r\u00e9v\u00e9lation de la maladie professionnelle. Ces fautes sont associ\u00e9es \u00e0 l\u2019intention de provocation de l\u2019AT. Ainsi, il est pr\u00e9cis\u00e9 \u00e0 l\u2019article 309 \u00ab qu\u2019aucune des prestations et indemnit\u00e9s pr\u00e9vues par le pr\u00e9sent dahir ne peut \u00eatre attribu\u00e9e ni \u00e0 la victime qui a intentionnellement provoqu\u00e9 l\u2019accident, ni aux ayants droit de cette victime \u00bb. En effet, selon l\u2019article 310 : \u00ab si l\u2019accident est d\u00fb \u00e0 la faute intentionnelle de l\u2019employeur ou de ses pr\u00e9pos\u00e9s, la victime ou ses ayants droit conservent contre l\u2019auteur de l\u2019accident le droit de demander la r\u00e9paration du pr\u00e9judice caus\u00e9 conform\u00e9ment aux r\u00e8gles du droit commun\u00bb.
